Abstract
تلقى الحوكمة الرشيدة في الآونة الأخيرة اهتماماً متزايداً في أقطار العالم؛ وذلك لدورها الكبير في زيادة الكفاءة والفعالية وتحقيق الشفافية، ومعالجة المشكلات الإدارية، ومكافحة الفساد المالي والإداري. ولقد تأثرت كافة القطاعات الفلسطينية بشكل سلبي نتيجة للانقسام الفلسطيني الذي أثر على كافة المؤسسات العاملة في فلسطين بما في ذلك مؤسسات الزكاة. باتباع المنهج الوصفي التحليلي، يهدف هذا البحث إلى بيان مدى تطبيق مبادئ ومعايير الحوكمة الرشيدة في مؤسسات الزكاة في فلسطين على ضوء الشريعة الإسلامية. وتشير أبرز نتائج هذا البحث إلى أنَّ الشريعة الإسلامية سبقت جميع المنظمات الدولية والمؤسسات العالمية بقرون في إرساء المبادئ العامة للحكومة الرشيدة، وأنَّ هناك ضعف في تطبيق معظم معايير الحوكمة الرشيدة في مؤسسات الزكاة في فلسطين نتيجة للانقسام السياسي الفلسطيني والاحتلال الإسرائيلي. ويوصي هذا البحث بضرورة الإسراع في إنهاء الانقسام الفلسطيني، وتفعيل المجلس التشريعي ليأخذ دوره التشريعي والرقابي والريادي في بناء منظومة الحوكمة الرشيدة، وتشكيل لجان لمراجعة التشريعات الفلسطينية المتعلقة بالزكاة والعمل على توحيدها وتعديلها بما يحقق مبادئ ومعايير الحوكمة الرشيدة، والعمل على تطبيق مبادئ الحوكمة الرشيدة في كافة مؤسسات الزكاة في فلسطين. وتكمن فائدة هذا البحث فيما يقدمه من توصيات من شأنها زيادة كفاءة وفعالية مؤسسات الزكاة الفلسطينية لتؤدي دورها على الوجه الأمثل. Good governance has recently received increasing attention in countries around the world for its great role in increasing efficiency and effectiveness, achieving transparency, solving administrative problems, and combating financial and administrative corruption. All Palestinian sectors have been negatively affected as a result of the Palestinian political division that has affected all Palestinian institutions, including Zakat institutions. Using the descriptive and analytical approach, this research paper aims to demonstrate the extent of application of principles and standards of good governance in Zakat institutions in Palestine in the light of Islamic Shari’ah. The most prominent results of this research indicate that Islamic law preceded all international organizations and global institutions by centuries in establishing general principles of good governance. And there is a weakness in the application of most standards of good governance in the Zakat institutions in Palestine as a result of the Palestinian political division and the Israeli occupation. This research recommends the necessity to expedite ending the Palestinian division, activating the Legislative Council to assume its legislative, supervisory and pioneering role in building a system of good governance, forming committees to review Palestinian legislation related to Zakat and to unify and amend it, and applying the principles of good governance in all Zakat institutions in Palestine. The benefit of this research is to provide recommendations that would increase the efficiency and effectiveness of Palestinian Zakat institutions so that they can perform their role optimally.
