Abstract

تقدم شركات الاتصالات في دولة الإمارات العربية المتح دة مجموعة كبيرة من الحوافز التسويقية بأشكال متنوعة، لترويج خدماتها، وترغيب الناس فيها، وضمان استمرارهم معها، وهذا قد يؤثر سلبا على الشركات التي لا تقدم مثل هذه الحوافز؛ لانصراف المتعاملين إلى الشركات التي تقدمها. تهدف هذه الدراسة إلى النظر فيما إذا كان استخدام شركات الاتصالات للحوافز التسويقية لترويج خدماتها؛ لجذب المتعاملين إليها يتوافق مع أحكام الشريعة الإسلامية، وعليه فقد تناولت الدراسة الأحكام الشرعية المتعلقة بالحوافز التسويقية، والتي تتمثل في القول بجواز البيع بأقل من سعر السوق لجذب المتعاملين أو عدم جوازه، ومن جهة أخرى ناقشت الدراسة حكم الاشتراك بمقابل في البرامج التحفيزية القائمة على جمع النقاط للحصول على المكافآت حيث إنها منطوية على نوع من الغرر والجهالة. واعتمدت الدراسة على المنهج الاستقرائي لجمع الحوافز التسويقية المقدمة من شركات الاتصالات، من خلال البحث في مواقع الشركات ورسائلها الترويجية، والمنهج التحليلي لببيان أنواع الحوافز التسويقية، ودراستها للوصول إلى التكييف الفقهي لها، والمنهج النقدي لدراسة أقوال الفقهاء وأدلتهم المتعلقة بمسائل البحث، ومناقشتها، لبيان الحكم الشرعي لهذه الحوافز. وخلص البحث إلى عدة نتائج، أهمها: جواز الحوافز التسويقية المباشرة التي تقدمها شركات الاتصالات للجمهور، لأن حقيقتها بيعٌ بأقل من السعر المعتاد، أو مآلها إلى ذلك، ويجوز كذلك تقديم الحوافز التسويقية من خلال الحصول على النقاط من عمليات الشراء من شركة اتصالات ثم استبدالها للحصول على التخفيضات أو الهدايا. ويوصي الباحث بإنشاء لجنة شرعية للنظر في المعاملات المالية التي تجريها شركات الاتصالات مع الجمهور، لبيان ما يحل منها ليُجاز، وما يحرم منها ليمنع، أو يعدّل عليه ليتوافق مع أحكام الشريعة الإسلامية. ********* Telecom companies in the United Arab Emirates are providing a big range of marketing incentives in different ways and multiple methods to promote their services, attract customers to their services and assure their continuity. This may effect on other companies that do not provide these services. This study aims to look at whether telecom companies use marketing incentives to promote their services; In order to attract customers to it, it complies with the provisions of Islamic law, and accordingly the study dealt with the Sharia provisions related to marketing incentives, which are represented in saying that it is permissible to sell at less than the market price to attract dealers or that it is not permissible, and on the other hand the study discussed the ruling on participating in exchange for incentive programs based on collecting points To obtain the rewards as it involves a kind of deception and ignorance. The study depends on inductive approach in collecting marketing incentives that the companies offer by looking up in companies’ websites and push messages. It also depends on analytical approach in clarifying the types of incentives and studying them to reach the juristic characterization to them. It also relied on critical approach to study the opinions of jurists and the evidence they relied on and discussion of that to reach the sharia ruling. I have included several main points. These incentives are permitted since they rely on reduction of price. Moreover, it is permitted to collect points and replace them to get rewards or reduction. It is important to establish a sharia committee in each company to explain what is permitted and what is forbidden or add amendments on the services to agree with Islamic law.
