Abstract
This This study examines the Islamic legal characterization (takyīf fiqhī) and Shariah compliance
of selected digital commercial platforms in Malaysia, namely Shopee, Lazada, TikTok Shop,
ZALORA, PG Mall, and Youbeli. Using a descriptive-analytical approach, the study analyzes
official platform documents, terms and conditions, and relevant fiqh literature. The findings
indicate that digital commercial platforms are generally permissible under Islamic law, as they
primarily function as intermediaries facilitating online transactions. Their legal characterization is
mainly associated with brokerage (simsārah), agency (wakālah), and service contracts (ijārah). The
study further finds that most platforms do not operate under comprehensive Shariah governance
frameworks, although certain financial products, such as SPayLater, have obtained Shariah
certification. In contrast, some services, particularly LazPayLater, raise Shariah concerns due to
the application of interest-based charges. The study concludes that the Shariah ruling on these
platforms depends largely on the nature of the transactions and financial mechanisms conducted
through them rather than on the platforms themselves.
