Abstract

This study analyzes environmental fatwas from Mufti departments in ASEAN countries like Malaysia, Indonesia, Singapore, Brunei, Thailand, and the Philippines—where Muslims form majorities—using Maqasid al- Shariah, especially Hifz al- Biah (environmental preservation). It applies qualitative document analysis and comparison, noting no such fatwas in minority- Muslim states like Vietnam, Laos, Cambodia, Myanmar, and Timor- Leste. Fatwas target issues such as pollution, deforestation, destructive fishing, GM foods, waste, wildlife protection, and climate change, drawing on Quranic rules against corruption, Prophetic teachings on stewardship (khalifah) and trust (amanah), and principles like “no harm” (la darar wa la dirar). Despite differences in content and processes due to local contexts, fatwas link Islamic ethics to modern sustainability, boosting awareness, policy, and faith- driven action against industrial damage. The study suggests wider preaching, ASEAN integration, more fatwas for new threats, and research to reinforce Hifz al-Biah in Shariah.
