Abstract

تتناول هذه الدراسة مدى فعالية المحكمة الجنائية الدولية في محاكمة مجرمي الحرب الإسرائيليين، في ظل انضمام دولة فلسطين رسمياً إلى ميثاق روما عام 2015. ورغم إحالة فلسطين لملف الجرائم الإسرائيلية المرتكبة منذ عام 2014 إلى المحكمة، وإقرار الدائرة التمهيدية الأولى عام 2021 بولاية المحكمة الإقليمية على الأراضي الفلسطينية (غزة، والضفة الغربية، والقدس الشرقية)، إلا أن مسار التحقيق لا يزال معطلاً مما يفاقم من معاناة الضحايا ويتيح استمرار الانتهاكات. بالاعتماد على المنهجين الاستقرائي والتحليلي، يسلط البحث الضوء على التحديات القانونية والسياسية التي تعرقل مسار العدالة؛ ومن أبرزها: سحب الاحتلال الإسرائيلي لتوقيعه على ميثاق روما، وتذرعه بالاختصاص القضائي الوطني، والإشكاليات المرتبطة بصياغة نصوص الميثاق، فضلاً عن الضغوط السياسية التي تمارسها الدول الكبرى، وتحديداً الولايات المتحدة الأمريكية. وتخلص الدراسة إلى تقديم توصيات عملية تهدف إلى تفعيل آليات المحاسبة الدولية، وضمان تقديم الجناة للعدالة، وإنصاف الشعب الفلسطيني. = This study examines the effectiveness of the International Criminal Court (ICC) in prosecuting Israeli war criminals, particularly following the State of Palestine's official accession to the Rome Statute in 2015. Although Palestine referred the file of Israeli crimes committed since 2014 to the ICC, and the Pre-Trial Chamber I affirmed the Court's territorial jurisdiction over the Palestinian territories (Gaza, the West Bank, and East Jerusalem) in 2021, the investigation process remains stalled. This delay exacerbates the suffering of victims and allows for continued violations. Utilising inductive and analytical methods, the research highlights the legal and political challenges hindering the path to justice. Key obstacles include Israel's withdrawal of its signature from the Rome Statute, its invocation of national judicial jurisdiction, problematic drafting of the Statute's provisions, and the political pressure exerted by major global powers, particularly the United States. The study concludes by offering actionable recommendations aimed at activating international accountability mechanisms, ensuring perpetrators are brought to trial, and achieving criminal justice for the Palestinian people.
