Abstract

The Malaysian Content Code 2022, revised and registered with the Malaysian Communications and Multimedia Commission (‘MCMC’) on 30 May 2022, represents a comprehensive update to the previous edition from 2020. The revision was driven by the need to address the rapidly evolving nature of the communications and multimedia industry. The Content Code, initially introduced in 2004, aims to promote industry selfregulation by establishing ethical standards and best practices for content providers in Malaysia. The 2022 revision introduces several significant amendments, including the expansion of the Code’s application to online service providers, refinement of the complaints procedure, and enhancements to protect vulnerable groups such as children and persons with disabilities. Key updates include new provisions addressing online abuse and gender-based violence, stricter standards for advertisements to ensure accuracy and truthfulness, and specific guidelines for content involving nudity, which is now permissible under limited and non-explicit circumstances related to art, information, and sciences. The revision also extends the scope of regulated advertisements to cover digital media and mandates compliance from social media influencers. The Content Code 2022 seeks to create a dynamic, progressive, and safe content landscape by fostering a platform for creativity and innovation while ensuring alignment with Malaysian cultural values. The updated Code underscores the importance of self-regulation, transparency, and accountability among all content creators and disseminators, aiming to maintain its role as the primary reference point for content regulation in Malaysia.
