Abstract

إن انتشار مرض الإيدز ليس قضية جديدة في العالم، حيث بدأ في أمريكا سنة 1981م وانتشر بشكل متزايد على مر السنين. وتُطرح قضية فقهية مستجدة تتعلق بهذا المرض، خاصةً قضية الزواج مع المصاب بهذا الوباء، ويمكن أن تنشأ مشاكل صحية واجتماعية إذا لم يتخذ المصابون التدابير الوقائية اللازمة. فتهدف هذه الدراسة إلى تحقيق الآراء والأحكام المستنبطة من الفقهاء المتقدمين والمعاصرين حول هذه المسائل، وتقديم الحلول لهذه المشكلة الكبيرة، خاصةً بالنسبة للمسلمين، كما تتناول الدراسة القانون المطبق في ماليزيا للأشخاص الذين أصيبوا بهذا الفيروس وهم يرغبون في الزواج. اختار الباحثان في هذه الدراسة ثلاثة مناهج، المنهج الاستقرائي حيث قام الباحثان بالتتبع والاستخراج للمعلومات من المقالات الموثوقة المتعلقة بالإيدز وفيروس نقص المناعة المكتسب (HIV) والفتوى في ماليزيا عن زواج المصاب به، والمنهج التحليلي الذي يشمل تحليل أسباب وآثار العادات المتعلقة بهذا المرض، وكذلك المنهج المقارن حيث قارن الباحثان أقوال أهل العلم بهذا الخصوص، من خلال المناقشة بين ما نص عليه الفقه الإسلامي فيما يتعلق بالزواج مع المصابين بالأمراض المعدية وبين القوانين المدينة التي يتبعها البعض. وينتج البحث ببعض النتائج المهمة، منها أن الزواج مع المصاب يجوز شرعًا مع مراعاة الضوابط الشرعية والصحية، ويجب للمصاب الإخبار للزوجته أو زوجها مراعاةً لمقاصد الشريعة وهي حفظ النفس، وأن هذا المرض ابتلاء من الله تعالى على .عباده، وهو سبب لغفران الذنوب. وعلى المصاب أن يصبر ويحتسب الثواب من الله تعالى. ***** The spread of AIDS is not a new issue in the world, as it began in America in 1981 and has spread increasingly over the years. A new jurisprudential issue is raised related to this disease, especially the issue of marriage with someone infected with this disease, and health and social problems can arise if those infected person do not take the necessary preventive measures. This study aims to investigate the opinions and rulings drawn from ancient and contemporary jurists on these issues, and to provide solutions to this major problem, especially for Muslims. The study also addresses the law applied in Malaysia to people who have been infected with this virus and wish to get married. In this study, the researchers chose three approaches: the inductive approach, where the researchers tracked and extracted information from reliable articles related to AIDS and the acquired immunodeficiency virus (HIV) and the fatwa in Malaysia regarding the marriage of someone infected with the disease, and the analytical approach, which includes analysing the causes and effects of customs related to this disease, as well as the approach comparative. The two researchers compared the sayings of scholars in this regard, through a discussion between what Islamic jurisprudence stipulates regarding marriage with those infected with infectious diseases and the condemning laws that some people follow. The research produces some important results, including that marriage with an infected person is permissible according to Islamic law and health regulations, and that the infected person must inform his wife or husband, taking into account the purpose of shariah law, which is to preserve the soul, and that this disease is a test from God Almighty upon His servants, and is a reason for the forgiveness of sins. The afflicted person must be patient and expect reward from God Almighty.
