Abstract

يناقش هذا البحث موضوع عبء الإثبات في قرينة النشر الإلكتروني وفق القانون الماليزي والشريعة الإسلامية؛ حيث ينظر إلى عبء الإثبات باعتباره قاعدة قانونية في علم الإثبات ووظيفتها تحديد من يقع عليه عبء الإثبات، فلا تخلو أي دعوى قانونية من لزوم تقديم دليل الادعاء أو الاتهام، والذي يكلف بتقديم الاتهام أو الادعاء هو الذي يتحمل عب ء الإثبات. باتباع المنهجين الاستقرائي والتحليلي، يهدف هذا البحث إلى تسليط الضوء على دور المكلف بعبء الإثبات في قضايا النشر الإلكتروني في الدعاوى القانونية وفق القانون الماليزي والشريعة الإسلامية. ويخلص هذا البحث إلى أن القانون الماليزي من خلال المادة (114/أ) المتعلقة بقرينة النشر الإلكتروني يخالف المفهوم العام والشائع في علم الإثبات في الدعاوى القضائية الجنائية والمدنية؛ حيث إن عبء الإثبات في قرينة النشر الإلكتروني يقع على عاتق المدعى عليه في القضايا المدنية وعلى المتهم في القضايا الجنائية، وهذا يخالف الأصل في الإثبات أنه يقع على المدعي في القضايا المدنية وعلى النيابة العامة أو المدعي في القضايا الجنائية. وعليه فإن تطبيق عبء الإثبات في القانون الماليزي وفق المادة (114/أ) المتعلقة بقرينة النشر الإلكتروني يتعارض مع مبدأ "الأصل في الإنسان البراءة" المعمول به في الشريعة الإسلامية. ***** This research discusses the burden of proof in the presumption of electronic publishing under Malaysian law and Islamic law. It examines the burden of proof as a legal principle in the law of evidence and its function in determining who bears the burden of proof. No legal claim is exempt from the necessity of presenting evidence of the claim or accusation. The burden of proof lies with the party making the accusation or claim. Through inductive and analytical approaches, this research aims to shed light on the role of the burden of proof in electronic publication cases in legal proceedings according to Malaysian law and Islamic law. It is concluded that Malaysian law, through Article (114/A) concerning electronic publication, contradicts the general and common understanding in the law of evidence in criminal and civil cases. The burden of proof in electronic publication cases falls on the defendant in civil cases and on the accused in criminal cases, contrary to the principles applied in Shariah and law, which stipulate that the burden of proof lies on the plaintiff in civil cases and on public prosecution in criminal cases. Therefore, the application of the burden of proof in Malaysian law according to Article (114/A) concerning electronic publication conflicts with the principle of "innocent until proven guilty" or "presumption of innocence" applied in Islamic law.
