Abstract
يعد سهم المؤلفة قلوبهم أحد المصارف الثمانية التى نص الشارع الحكيم على استحقاقه للزكاة من بين المستحقين ، وقد طبق النبي صلى الله عليه وسلم هذا المصرف على مستحقه ممن تم تأليف قلوبهم من القبائل العربية وحقق المصرف مقاصده وغاياته، ثم طبقه الخليفة الأول كما كان يفعله رسول الله صلى الله عليه وسلم أول الأمر ثم ما لبث الأمر أن تغير، وفي خلافة سيدنا عمر لم يعط الفئات أو الأشخاص الذين طالما أخذوا النصيب من سهم المؤلفة قلوبهم! أسئلة البحث:ما السبب في منعهم ؟ هل منعهم سيدنا عمر (ض)حقا شرعه الله لهم ؟ هل عطل نصا أو سنة عملية فعلها النبي صلى الله عليه وسلم؟ أم لاحظ أمرا خفي عن الكثيرين ممن يقرأون النص ويفهمونه بصورة حرفية؟ هذا ما نود الكشف عنه في هذا البحث، وما المقصد من سهم المؤلفة قلوبهم وما وسائل تطبيق هذا السهم في ماليزيا، وما دور مؤسسات الزكاة في تفعيل وتطبيق مصارف الزكاة على المستحقين ومنها سهم المؤلفة قلوبهم. إشكالية البحث: تدور إشكالية البحث حول تفعيل وتشغيل هذا المصرف وكيف تقوم مؤسسات الزكاة –بماليزيا-عليه بما يحقق مقاصده في نشر الإسلام وتثبيت الإيمان اقتداء بالسنة النبوية في ذلك. منهج البحث: المنهج الوصفي التحليلي؛ حيث يقوم الباحث بوصف تحليلي لتطبيق السنة المطهرة لسهم المؤلفة قلوبهم حتى زمن سيدنا عمر ومن بعده ، وكيف نستلهم التطبيق للواقع المعاصر بماليزيا.خطة البحث: يتكون البحث من مقدمة وتمهيد ومبحثين وخاتمة وقائمة المصادر والمراجع:المقدمة :أهمية الموضوع وأسئلة البحث وإشكاليته ومنهج البحث والدراسات السابقة والخطة المقترحة .التمهيد:مداخل تمهيدية ومصطلحات البحث.المبحث الأول: غياب المحل وأثره بين الأصوليين والفقهاء.المبحث الثاني:دور مؤسسات الزكاة بماليزيا في تطبيق سهم المؤلفة قلوبهم.الخاتمة ونتائج البحث.المصادر والمراجع. ***** Mu'allafah Qulūbuhum's share is one of the eight asnaf zakats that can be drawn from the pool of deserving individuals for zakat. In order to help the Mu'allafah Qulūbuhum achieve its goals and objectives, the Prophet Muhammad (SAW) used to pay it zakat. Later, the first Caliph followed the prophet's ruling or regulation. Omar did not offer Mu'allafah Qulūbuhum zakat during his third caliphate; instead, their portion was adjusted! Among the many questions the study raised was this one: Why is Mu'allafah Qulūbuhum banned without giving them zakat duaring Omar era? Did Omar RA deny them a privilege that God had given them? Did he follow any scripture or practical Sunnah that he disregarded? Or did he see something that those who read the passage and took it literally were missing? In this study, we want to elucidate the meaning of the Mu'allafah Qulūbuhum arrow, its application in Malaysia, and the function of zakat institutions in facilitating the activation and distribution of zakat disbursements to the worthy. The study's main problem is how to activate and run this asnaf and how Malaysia's zakat institutions manage it to fulfil the Prophet's Sunnah in this regard while also achieving the goals of developing faith and propagating Islam. We took a descriptive and critical stance. Here, the authors analyze how the Sunnah was applied to the asnaf Mu'allafah Qulūbuhum up until Omar's time and beyond, and how we can draw inspiration from this and apply it to Malaysia's current situation.
