Abstract

السلطة التشريعية تعد أحد أهم السلطات الثلاث في الدولة، فهي التي تسن القوانين التي تنفذها السلطة التنفيذية وتطبقها السلطة القضائية، كما تراقب على السلطة التنفيذية في أدائها لمهامها. وقد تم انتخاب المجلس التشريعي الفلسطيني الحالي بتاريخ 25/01/2006م، وفازت كتلة التغيير والإصلاح (حركة حماس) بالأغلبية. وبعد مرور سنة ونصف حدث الانقسام بين الفلسطينيين، وبعدها أصبحت كتلة التغيير والإصلاح تعقد جلسات للمجلس التشريعي في قطاع غزة، في حين تم إلغاء عمل المجلس التشريعي في الضفة الغربية، وأصبح الرئيس يصدر قرارات بقوانين، وتمارس الكتل والقوائم البرلمانية في الضفة الغربية -باستثناء كتلة التغيير والإصلاح- بعض المهام التشريعية والرقابية في الضفة الغربية. ونظراً لما تبع ذلك من إصدار تشريعات مختلفة في الضفة الغربية وقطاع غزة، وإنشاء مراكز قانونية بناء على هذه التشريعات، كان لا بد من تناول هذا الموضوع تحت عنوان: "دور المجلس التشريعي الفلسطيني خلال فترة الانقسام"، من خلال الحديث عن الدور التشريعي للمجلس التشريعي الفلسطيني خلال فترة الانقسام، ثم تناول الحديث عن الدور الرقابي للمجلس، وأخيراً بيان مصير التشريعات والأعمال الصادرة خلال فترة الانقسام الفلسطيني، وذلك باتباع المنهجين الاستقرائي والتحليلي. The legislative authority is one of the three most important authorities in the state. It enacts laws that are implemented by the executive authority and applied by the judicial authority. It also monitors the executive authority in the performance of its duties. The current Palestinian Legislative Council was elected on January 25, 2006, and the Change and Reform bloc (Hamas movement) won the majority. After a year and a half had passed, the division occurred among the Palestinians, after which the Change and Reform Bloc began to hold sessions for the Legislative Council in the Gaza Strip, while the work of the Legislative Council in the West Bank was stopped, and the President issued decrees by laws, and parliamentary blocs and lists practiced in the West Bank - with the exception of the Change Bloc. Reform - some legislative and oversight functions in the West Bank. In view of the subsequent issuance of various legislations in the West Bank and Gaza Strip, and the establishment of legal centers based on these legislations, it was necessary to address this topic under the title: “The Role of the Palestinian Legislative Council during the Period of the Political Division”, by explaining the legislative role of the Palestinian Legislative Council during the period of the political division, the oversight role of the Council, and the fate of legislation and actions issued during the period of Palestinian political division by following the inductive and analytical approaches.
