Abstract

The ‘Legal Method’ course is offered to undergraduate law students and is often undertaken usually at the beginning of the law programme. The course would facilitate the students to have a proper understanding on the application of the various substantive and procedural laws which they will encounter as they advance in their legal studies. Undeniably, reading law would require the concurrent development of a wide range of different but complementary skills namely, general study skills, language skills, substantive and procedural legal knowledge skills, and legal method skills. These skills are necessary for purposes of argument identification, interpretation of statutes, legal reasoning, argument construction and deconstruction in answering legal questions, legal research and writing skills, and oral argument skills, among others. The Legal Method book which consists of nineteen (19) chapters, covers a wide range of important components of the course namely, the sources of Malaysian laws; the law-making process in Parliament and the drafting of bills; the common law rules on statutory interpretation as well as the intrinsic and extrinsic aids, the rules of language, legal maxims, and presumptions. The application of the doctrine of binding precedent under the common law tradition and Syariah is also featured in this book. The other highlights of the book include the judicial process, judicial legal reasoning, writing judgments, legal research skills, and writing legal research proposals. Besides, it also covered the use of technology in delivering legal services and in administering justice with reference to Artificial Intelligence (AI) and Metaverse. The contents of this book are contributed by a pool of local and international academics, the subject matter experts, to cater for the needs of law students which predominantly aimed at shedding light on the legal method skills necessary for understanding the theoretical and practical application of the law and legal rules. The coverage of this book is largely the Malaysian contents and with reference to both the common law tradition and the Islamic legal tradition. Undoubtedly, the book would be an excellent source of reference for law students to reach a position of proper understanding of existing laws, identify appropriate sources of law, interpret statutes confidently, construct and deconstruct arguments through legal reasoning in answering legal questions, and conducting viable legal research, among others. The book would also be useful for others, whether from legal or non-legal communities, to understand the theoretical and practical application of Malaysian laws. Besides, the chapters have been written in simple language and the contents are easily comprehensible. At the outset, we, the general editors of this title, would like to express our heartfelt appreciation to all the contributors for their extensive research to prepare this collection of law, principles, and authorities. Their research and multifarious knowledge would certainly make this book an excellent source of reference for all those interested in this subject.
