Abstract

هدفت هذه الدراسة إىل بيان التكييف الفقهي للمنصات التجارية الرقمية يف ماليزاي وحتليل مدى توافقها مع أحكام Lazada و Shopee الشريعة اإلسالمية، من خالل دراسة عدد من أبرز املنصات املستخدمة يف السوق املاليزية، وهي: . واعتمدت الدراسة على املنهج الوصفي التحليلي من Youbeli و PG Mall و ZALORA و TikTok Shop وخالل حتليل الواثئق الرمسية للمنصات، وشروط االستخدام، والدراسات السابقة، والقرارات الفقهية املعاصرة ذات الصلة ابحة؛ ألهنا متثل ابلتجارة اإللكرتونية واملعامالت الرقمية.وتوصلت الدراسة إىل أن األصل يف املنصات التجارية الرقمية اإل وسائل تقنية حديثة لتيسري عمليات البيع والشراء، وأن التكييف الفقهي الغالب هلا يتمثل يف عقود السمسرة أو الوكالة أو اإلجارة على اخلدمات اإللكرتونية حبسب طبيعة النشاط الذي تؤديه املنصة. كما أظهرت النتائج أن معظم املنصات SPayLater ابة شرعية مؤسسية شاملة، ابستثناء بعض املنتجات املالية احملددة، مثل خدمة حمل الدراسة ال ختضع لرق اليت حصلت على اعتماد شرعي من جهة استشارية متخصصة. ويف املقابل، تبني وجود Shopee التابعة ملنصة اليت تعتمد LazPayLater إشكاالت شرعية يف بعض اخلدمات التمويلية املرتبطة مبنصات أخرى، وال سيما خدمة على الفائدة بصورة صرحية. وأوصت الدراسة بضرورة تعزيز احلوكمة الشرعية للمنصات التجارية الرقمية، ووضع معايري شرعية موحدة لتقومي اخلدمات املالية والتجارية املرتبطة هبا. This This study examines the Islamic legal characterization (takyif fight) and Shariah compliance of selected digital commercial platforms in Malaysia, namely Shopee, Lazada, TikTok Shop, ZALORA, PG Mall, and Youbeli. Using a descriptive-analytical approach, the study analyzes official platform documents, terms and conditions, and relevant figh literature. The findings indicate that digital commercial platforms are generally permissible under Islamic law, as they primarily function as intermediaries facilitating online transactions. Their legal characterization is mainly associated with brokerage (simsarah), agency (wakalah), and service contracts (ijarah). The study further finds that most platforms do not operate under comprehensive Shariah governance frameworks, although certain financial products, such as SPayLater, have obtained Shariah certification. In contrast, some services, particularly LazPayLater, raise Shariah concerns due to the application of interest-based charges. The study concludes that the Shariah ruling on these platforms depends largely on the nature of the transactions and financial mechanisms conducted through them rather than on the platforms themselves.
