Abstract

يسلط هذا البحث الضوء على جريمة الاتجار بالبشر في القانون الجزائري ، حيث نظم المشرع الجزائري أحكامها بعد انضمامه للعديد من الاتفاقيات والمعاهدات الدولية ، والتي من خلالها قام بتعديل قانون العقوبات سنة 2009 بمقتضي القانون رقم 09-01 ، ويهدف هذا البحث عموما إلى التعريف بجريمة الاتجار بالبشر في قانون العقوبات الجزائري 09-01 ، مع بيان صور السلوك الإجرامي لجريمة الاتجار بالأشخاص وصور الاستغلال و التطرق لوسائل ارتكاب الجريمة وقمعها ، باستخدام كل من المنهج المقارن لكشف أوجه الشبه والاختلاف بين القانون الدولي والقانون الجزائري،وكذا المنهج التحليلي الاستقرائي من خلال وصف المواد القانونية المتعلقة بجريمة الاتجار بالبشر وتحليلها وكل هذا بغرض الوصول إلى هدف هذه الدراسة. This research highlights the crime of trafficking in human beings in Algerian law, where the Algerian legislature regulated its provisions after it acceded to numerous international conventions and treaties, through which it amended the Penal Code in 2009 by Law No. 09-01 This research is generally aimed at introducing the crime of trafficking in human beings into Algerian penal law 09-01, With a view to demonstrating the criminal conduct of the crime of trafficking in persons, the forms of exploitation and the methods of committing and suppressing the crime, using both the comparative approach to the detection of similarities and differences between international and Algerian law; It is also an inductive analytical approach by describing and analyzing legal material related to the crime of trafficking in human beings with a view to reaching the objective of this study.
