Abstract

الملخص : يعد هذا البحث من أهم الموضوعات القانونية وأكث رها جدلا في عصرنا الحديث، ويعتبر من الموضوعات التي تشغل المحاكم يوماً بعد يوم، ويرتبط هذا الموضوع بمسؤولية الدائن والمدين والتزامهما بمقتضى العقد، وتم البحث في هذا الموضوع ويستنتج بأن الشرط الجزائي يؤدي وبشكل فعال الى ضرورة تنفيذ الإلتزام بين طرفي العق د، ويعتبر وسيلة للضغ ط على الطرفين حتى يقوم بتنفيذ ماتم الاتفاق عليه. ------ This research is considered one of the most important legal topics and is more applied in our current era. However, it is considered one of the topics that occupy the courts day after day, and this issue is related between the creditor and the debtor and the imposition of both of them to adhere to what was described in the contract, and this topic was researched and we concluded that the penalty clause effectively leads to an investigation implementation of the commitment between the two parties, and a means to exert pressure on the two parties to implement what has been committed.
