Abstract

تطرق هذا البحث قضية حقوق الطفل قبل ولادته الشامل فترة كون الطفل في رحم الأم ولاسيما فترة اختيار الأب شريكة حياته من حيث الشريعة الإسلامية. استخدمت في هذا المقال المنهج التحليلي من خلال تحليل النصوص القرآنية والسنة النبوية وفروع الفقه الإسلامية المتعلقة لحقوق الطفل قبل ولادته سواء فترة وجوده في رحم الأم أو قبل فترة زواجه. وبعد تحليل كثير من النصوص توصل الباحث إلى بعض النتائج منها وجود بعض الأمور التي أوجب الإسلام على الوالدين قبل ولادة الطفل بل قبل زواجه كاتحاد الدين بين الرجل والمرأة، وعدم المحرمية بينهما، وهذا الأمر له أهمية كبيرة في حياة الطفل ونموه في المستقبل، وك ذلك أن الطفل قبل ولادته له ذمة مالية بحي ث يمكن أن يرث مالا وهو مازال في رحم أمه. كوذلك يوجد بعض الأمور فيما يتعلق بحقوق الطفل لم يبلغ مرتبة الوجوب لصغر احتمال تأثر الطفل بذلك الأمر مثل سنية كون المرأة دينية وعدم القرابة القريبة بين الرجل والمرأة، وكل هذا الأمر قد رتبه الإسلام قبل ولادة الطفل حتى يلد الطفل وينمو نموا كالملا ويحصل على جميع حقوقه. ************************************************************************ This journal discusses the rights of children before they are born, especially when a father chooses a life partner and when a child is in his mother womb is a Islamic perspective. In this journal I use the analysis method by analyzing text’s in holly quran, sunnah & Islamic law related to the rights of children before they are born while still in the womb or before the marriage accurs. At that time I came to the conclusion the there are several obligation in islam that must be fulfilled by parents before the childs is born, such as religious similarities between husband & wife, also no mahromiyah relationship between husband & wife, as well as a child when in the womb has he right to have money. Likewise, there are some things thet are not required by islam to parent such as choosing a pious partner & thre is no relative relationship between husband and wife, all of which are so that the child can grow up perfectly & all of that has been regulated by islam before the child is born into this world.
