Abstract

الإجماع من أقوى الأدلة الشرعية التي تثبت بها الأحكام، ومن اطلع على كتب الفقه وأصوله فسيقف على معرفة قيمة هذا الأصل وأهميته في الدين، بل قد اعتبرت معرفة اتفاق العلماء في المسائل الشرعية من الضروريات، وهو من الشروط المتفق على وجوب توفرها في المجتهد حتى لا يفتي أو يجتهد بخلاف ما اتفقت عليه الأمة. وحيث إنّ الإجماع -بعد أن تهيأت وسائله المطلوبة- هو وسيلة فعّالة لتوحيد الأمة وتقليل الاختلاف بين مذاهبها، لذا أحبّ الباحث أن يبرز مسائله، سيّما المسائل التي حكاها العلّامة ابن بطال المالكي في حرمة مال المسلم وفي البيع بالنسيئة في كتابه شرح صحيح البخاري، فهي لا تزال من أهم القضايا الدينية، التي تتطلب جهداً علمياً وعملياً في تحليلها وإثبات صحّة الإجماع فيها. ويحتوي البحث على ثلاثة فروع ثم الخاتمة وذلك بذكر أهم النتائج والمراجع وهي كالتالي: الفرع الأول: مفهوم الإجماع. الفرع الثاني: بالتعريف بالعلامة ابن بطال المالكي. الفرع الثالث: دراسة إجماعات العلّامة ابن بطّال في حرمة مال المسلم وفي البيع بالنسيئة. ****************************************************************************** Alijma’ is one of the strongest legal evidence that proves the Islamic rulings. so the researcher liked to highlight his issues, especially the issues narrated by the scholar Ibn Battal al-Maliki in the sanctity of Muslim money and credit sale in his book Syarh Sahih Bukhari, which requires a scientific and practical effort in analyzing it and establishing the validity of consensus therein.The research contains three sections and then the conclusion by mentioning the most important results and references are as follows: Section I: The Concept of Consensus. Section II: the definition of the mark Ibn Batal Maliki. Section III: Study of the consensus of the scholar Ibn Battal in the sanctity of the wealth of the Muslim and credit sale.
