Abstract

تحولّت المُقاصة في العصر الحديث من مجرد معاملة بسيطة كانت تتمُّ بين طرفين كلٌ منهما دائنٌ للآخر ومدينٌ له إلى عملية آلية وتقنية واسعة الانتشار، تشترك فيها أطراف متعددة، ليس في البلد الواحد فقط، بل على نطاق العالم بأسره، ولكن قد تجري هذه المُقاصة بين الكثير من البنوك والمؤسسات المالية دون نظر، أو مراعاة لحرام أو حلال، فكان لابدّ من أخذ الحيطة والحذر في ذلك. ونظراً لأهمية المُقاصة وانتشارها وجدنا أهمية الكتابة حول أهم الصور والتطبيقات المعاصرة لها، وفي مقدمتها تلك التي تجريها البنوك بينها وبين عملائها في ديونها المستقبلية المستقرة، بالإضافة إلى المُقاصة بين الفوائد الدائنة والمدينة سواء بينها وبين البنوك أو بينها وبين الأفراد. ومن أهم النتائج التي توصلنا إليها في هذا البحث هي: أولاً، يجوز شرعاً الاتفاق بين البنك وعميله على إجراء المُقاصة بينهما فيما ينشأ من ديون في المستقبل بشكل عام، ما دامت تنطبق عليها شروط المُقاصة الصحيحة، ثانياً، عدم مشروعية المُقاصة بين الفوائد الدائنة والمدينة؛ وذلك لكونها تقوم على الإقراض والاقتراض بفائدة، وأما بالنسبة لبدائلها المطروحة، فإن منها ما يلحق بها في عدم الجواز، كالأرصدة التعويضية، ومنها ما أجازتها الهيئات الشرعية والندوات الفقهية لخلوها من الفوائد الربوية. واتبعنا في بحثنا هذا المنهج الوصفي، وذلك لبيان الصور المختلفة للمقاصة، بالإضافة إلى المنهج التحليلي المقارن، وذلك لتوضيح الفرق بين هذه الصور، ومن ثم الوصول إلى الحكم الشرعي لها، وقد قسمنا البحث إلى مبحث تمهيدي يتضمن تعريف المُقاصة وحكمها الشرعي، ومبحث أول يتضمن المُقاصة بين الديون المستقبلية المستقرة وحكمها الشرعي، ومبحث ثاني يتضمن المُقاصة بين الفوائد الدائنة والمدينة وحكمها الشرعي. Setting of debts in modern time (MuqÉÎÎah) has transformed from a mere simple transaction that was between the borrower and lender into a ubiquitous technical mechanism that involved various parties, not only restricted to one single country only but also the whole world. We use the descriptive method in this paper to explain the various forms of muqÉÎÎah in addition to the comparative analytical analysis. This is to enable us to point out the differences between these forms. Subsequently this would enable us to arrive at the Islamic ruling on the matter. Among the most important findings are: first, it is permissible generally for the bank and its client to set off future debt between them provided that the ample setting off conditions were applied; second, the illegality of setting off the interests of the debtor and lender as it is based on borrowing with interest. As for its alternatives, come of them are not permissible in Islam such as credit offset. The Shari’a and Fiqh Council also had approved some of them which has no interest.
