Abstract

يُعتبر مجمع الفقه الإسلامي الدولي من أهم المجامع الفقهية التي تقوم بدراسة مشاكل العصر في شتى مناحي الحياة، وتقديم فتاوى وحلول مناسبة للعصر عبر الاجتهاد الجماعي. وهذه الورقة تحاول دراسة مدى تأثير مجمع الفقه الإسلامي الدولي على المؤسسات المالية الإسلامية من حيث التزام هذه المؤسسات بالقرارات التي تصدر عن المجمع. تقدم الدراسة نبذة تاريخية عن مجمع الفقه الإسلامي الدولي وذلك ببيان تعريف المجمع ونشأته وهيكله التنظيمي والأنشطة التي يقوم بها، ثم تتعرض الورقة لأبحاث المجمع وقراراته بشأن الصكوك الاستثمارية الإسلامية، ثم تتطرق إلى الواقع التطبيقي للصكوك الإسلامية، كما تكشف عن أثر أبحاث المجمع وقراراته بشأن الصكوك الاستثمارية الإسلامية على المؤسسات المالية الإسلامية. وتعتمد الدراسة المنهج الوصفي والمنهج الاستقرائي والمنهج التحليلي للوصول إلى نتائج البحث المرجوة. Abstract The International Islamic Fiqh Academy (IIFA) is considered one the most important jurisprudential academies which undertake studies on contemporary issues in various aspects of life and act as a repository of knowledge for Shari’ah views and offer Fatwas as well as contemporary solutions through collective Ijtihad. This paper attempts to examine its impact on Islamic financial institutions in terms of compliance of these institutions to the resolutions issued by it (IIFA). The study provides a brief historical background about The International Islamic Fiqh Academy by explaining its definition, its establishment, its organizational structure and the activities carried out by it. Then it highlights and discusses the research and resolutions of the (IIFA) regarding Islamic investment sukuk. It also addresses the practical reality of sukuk. It also brings to light the impact of the research and resolutions of the International Islamic Fiqh Academy on Islamic financial institutions concerning Islamic investment sukuk. The study adopts descriptive, inductive and analytical method to arrive at the desired research results.
