Abstract

The integration of Artificial Intelligence (AI) into the healthcare ecosystem is reshaping traditional decision-making processes in medical settings worldwide. Generally, the doctrine of informed consent has long served as a cornerstone of patient autonomy, affirming that every individual has the right to make decisions aligned with their personal values and beliefs. Nevertheless, the adoption of AI driven technologies introduces novel ethical, legal, and procedural challenges, including questions of liability, transparency, and the adequacy of existing consent policies. This paper explores the impact of AI on informed consent processes by examining how AI tools affect patient comprehension, disclosure practices, and decision-making autonomy. Through a comprehensive review of the impact on emerging AI applications on relevant Malaysian statutory laws, medical policies and guidelines, this paper will identify gaps and uncertainties in the current informed consent practices affected by the development of AI within the Malaysian healthcare landscape. Subsequently, this paper will provide insights for policymakers, healthcare practitioners, and legal professionals seeking to navigate the intersection of technology, ethics, and law in informed consent practices, and will propose recommendations for reforming the laws and ethics governing informed consent in the AI era.
