Abstract

A one of the husband responsibilities and basic needs for the family is nafaqah to create a Sakinah (tranquility), mawaddah (love) and rahmah (mercy) household life. Islam explicitly places women as equal partners with men as stated in al-Qur'an Surat At-Taubah “The believers, both men and women, are guardians of one another” (Surah At-Taubah 9:71). The way that classical fiqh defines men and women responsibilities in the home is misinterpreted, with men serving as family leaders and women as housewives. The male responsibilities as heads of households entails that they are solely accountable for providing the means of subsistence for their spouses and children, while wives are also obligated to take care of all household necessities, beginning with their duty to assist and serve their husbands and to look after their children at home. However, the topic of family support frequently becomes a source of conflict in our globalized period, particularly amongst parties going through divorce or separation. When unrelated third parties file claims for mandatory support without taking into account the responsible party's capacity to supply it, the situation gets more difficult. Some argue that support must be given in the form of cash, but in reality, support can take the shape of non-material items like being present at home.
