Abstract
تُعد مسالة ميراث ذوي الأرحام من المسائل اختلف فيها الفقهاء بين المذاهب، حيث ذهب بعضهم إلى توريثهم بعد أن يأخذ أصحاب الفروض والتعصيب نصيبهم، بينما ذهب آخرون إلى عدم توريثهم. ، أما في المذهب الشافعي، فقد تعددت الأقوال في هذه المسألة. وفي هذا البحث، يتناول الباحث تعريف ميراث ذوي الأرحام، ويستعرض آراء فقهاء الشافعية في مسألة توريثهم ، بالإضافة إلى استعراض الطرق المتبعة في توريثهم عند من قالوا بذلك. و قد تضمن البحث ثلاثة مباحث؛ فالمبحث الأول يتناول تعريف ذوي الأرحام ومرتبتهم بين الورثة في الميراث، والمبحث الثاني يستعرض آراء فقهاء الشافعية في مسألة توريثهم، بينما يتناول المبحث طرق توريث ذوي الأرحام. يعتمد البحث على منهجين؛ الأول هو المنهج اللاستقرائي لجمع المعلومات، والثاني هو المنهج التحليلي لتحليل أقوال فقهاء الشافعية وأدلتهم في مسألة توريث ذوي الأرحام. وقد اختتم البحث بذكر أهم النتائج التي توصل إليها الباحث، ومنها: تتباين آراء الفقهاء في التعامل مع ميراث ذوي الأرحام، ولكنهم اتفقوا على أنه لا يُورثُ ذوو الأرحام إذا كان للميّت ورثة بالفروض أو بالتعصيب عدا الزوجين، واختلفوا في توريثهم إذا لم يكن للميّت ورثة بالفروض أو بالتعصيب، أو إذا تبقى شيء من التركة بعد نصيب أحد الزوجين. ***** Theissue of the inheritance of relatives by marriage (Dhawi al-Arham) is a debated topic among the Islamic jurisprudential schools. Some scholars argue that they inherit after the rightful heirs with fixed shares and those who inherit by agnatic descent, while others hold that they should not inherit at all. There are also different opinions within the Shafi’i school regarding their inheritance. This research will address the definition of Dhawi al-Arham, the views of Shafi’i scholars on their heritance, and the methods of inheritance according to those who permit it. The research consists of three main sections: the first discusses the definition of Dhawi al-Arham and their rank among heirs in inheritance; the second addresses the opinions of Shafi’i scholarson the inheritance of Dhawi al-Arham; and the third focuses on the methods of inheritance for Dhawi al-Arham according to those who support their inheritance. This research utilizes two methodologies: the inductive method for gathering information and theanalytical method for analyzing the views of Shafi’i scholars and the evidence related to the inheritance of Dhawi al-Arham.The researcher concludes with some findings, including: the views of scholars on the inheritance of Dhawi al-Arham vary, but all agree that they do not inherit if the deceased has heirs with fixed shares or agnatic heirs, except for the spouses. There is a difference of opinion on their inheritance if the deceased has no heirs with fixed shares or agnatic heirs, or if there is a remainder in the estate after one of the spouses’ shares.
