Abstract

يسعى هذا البحث إلى تسليط الضوء على جانب مهم من جوانب مراعاة السياق بأقسامه الثلاثة، وهي: السياق واللحاق والقصد أو الغرض الذي خرج عليه الخطاب وقرائن الحال، في الوصول إلى المراد والفائدة التي نزل عليها الخطاب، والكشف عن أبعاد ذلك الجانب وأهميته المتمثلة في صحة النتائج المتوصل إليها والتي راعت ذلك الجانب واستندت إلى قواعده وأصوله. ونظرا إلى أهمية المسألة فقد عمد البحث إلى إجراءٍ تطبيقيٍ انطلق فيه من بيان مكانة السياق وأهميته عن اللغويين، وكذلك احتفائهم به نتاجاً للدرس اللغوي الحديث الذي يمكنه الكشف عن أسرار الكلام وحقيقة مقصود المتكلم، وصولاً إلى بيان موقف الأصوليين من هذه الطريقة اللغوية، ومدى اعتمادهم عليها في الوصول إلى قصد الشارع من كلامه باعتبار الطبيعة الوظيفية التي أنيطت بهم، وعلى رأسها الاستنباط من القرآن الكريم. ونظراً إلى الطبيعة النظمية للقرآن والمبنية على خصائص اقضتها حيثيات النزول وكيفية الترتيب؛ لذلك تفرقت الكثير من الآيات التي يجمعها عنوان موضوعي واحد في أماكن متفرقة، الأمر الذي جعل الجانب الفقهي والمتمثل بآيات الأحكام مجالاً خصباً لإعمال النظر، ومسرحاً كبيراً للاجتهاد والاختلاف؛ لذلك جاء هذا البحث ليسلط الضوء على هذا الجانب المهم من خلال استثمار آليات النظرية السياقية المتمثلة في عناصرها المعروفة، وسعياً إلى تحديد نطاق البحث فقد اعتنى البحث بآيات الأحكام بوصفها ميداناً للكشف عن أهمية الموضوع، وكذلك مراعاة لطبيعة البحث في الاختصار، فجاءت تلك الآيات تتويجًا للسرد النظري وبرهانًا عمليًا له، فكانت مرتبة تحت عناوين موضوعية، يبيّن فيها البحث كيفية اعتماد القرائن السياقية والعمليات الإجرائية التي تعتريها وصولاً إلى الحكم التكليفي المتمثل في مراد الشارع. الكلمات المفتاحية: السياق، علماء الأصول، المعاني، التطبيق. Abstract: This research aims to illuminate a crucial aspect of context by examining its three components: context, catch-up, and the intent or purpose behind a speech, along with the contextual evidence necessary for deriving the intended meaning and benefits of that speech. It seeks to reveal the significance of these dimensions, particularly how they contribute to the validity of results that consider context and are grounded in its principles. Recognizing the importance of this issue, the research adopts an applied approach, beginning with an exploration of the status of context and its relevance to linguists. It highlights how modern linguistic studies celebrate context to uncover the nuances of speech and the true intentions of speakers. Furthermore, it clarifies the positions of fundamentalists regarding this linguistic method and their reliance on it to discern the intentions of the Lawgiver in His discourse, particularly in the context of deducing meanings from the Holy Quran. Given the Quran's organizational structure and the characteristics shaped by the circumstances of revelation and arrangement, many verses sharing a common thematic focus are dispersed throughout the text. This scattering creates a fertile ground for jurisprudential analysis, especially concerning verses related to legal rulings, thereby inviting ijtihad and differences of opinion. Thus, this research aims to shed light on this important aspect by utilizing the mechanisms of contextual theory and its established elements. To define the scope of the study, it concentrates on verses of rulings as a field for revealing the topic's significance. The research is designed to be concise, presenting these verses as a culmination of theoretical insights and practical evidence. They are organized under thematic titles to illustrate how to rely on contextual evidence and the processes that influence it to reach the obligatory rulings that reflect the will of the Lawgiver.
