Abstract
A construction contract is a legally binding agreement between two parties called a client (owner) and a contractor. This agreement or document commonly outlines the terms, conditions, and details of a construction project. It establishes the rights, responsibilities, and obligations of each party involved in the construction process. A construction contract serves as a road map, fostering clarity and collaboration to achieve the desirable goal of the project. The common features of the construction contract and how they are similar to and different from an ordinary contract form the discussion of this chapter. It is also worth noting that the complexity of the industry always results in complex disputes and hence, prompt attention is required to get construction disputes resolved through an effective mechanism before they become complex and very expensive to manage. While the construction-related disputes can be resolved either by way of adjudication in the ordinary courts or by way of alternative dispute resolution, the chapter will specifically discuss the expeditious settlement of such dispute vide statutory adjudication and adjudication by the specialist construction court.
