The “Right to Non-Discrimination” in Universal Declaration of Human Rights (UDHR): a Qur’anic analysis

Abstract

The fundamental human right, “Right to Non-Discrimination” has been expressed in Article 2 of the “Universal Declaration of Human Rights (UDHR) 1948”. It had already been stated centuries before in the Qur’an and Sunnah. However, this right has been abused and violated with impunity throughout the world despite clear recognition and stern protection of it by the UN and paramount emphasis in the Qur’an and Sunnah. This study therefore, aims to explore how this “Right to Non-Discrimination” has been worded in UDHR and Qur’an and Sunnah; how UN and the Qur’an and Sunnah are protecting it; and whether it is compatible with the texts and the instructions of the Qur’an and Sunnah of prophet (PBUH). Descriptive, analytical, evaluative and critical methods have been adopted in this study to describe this right in the UDHR and in the Qur’an, to analyse and evaluate its position in the light of the Qur’an and provide critical evaluation whenever necessary. The study explores how this “Right to Non-Discrimination” has been worded in the UDHR wherein no clause appears to be inconsistent with the Qur’an and Sunnah. The incompatibility appears when opportunists aim to reach their preconceived notions and make conclusions through misinterpretation of the clauses of this right. As for urging same-sex marriage right for LGBT, which is not clearly mentioned in the wording of this right, this right is presumed to be contradictory with the Quranic teachings is also the effect of misunderstanding and misinterpretation. Consequently, the violation of this right is widespread, such as seen when the people of disability, migrants, indigenous, minority and LGBT are being discriminated on grounds of their gender, race, colour, ethnicity, religion, etc.
