Abstract

The paper aims to touch on the issue of shariah compliance governance in the application of taqarruq at the current financial institutions. This is due to the fact that this instrument is one of the most significant Sharia’ based contracts that had increased the creative aspects of contemporary financial products and instruments based on its basic model. The Malaysian Commodity Market is chosen as a case study as it is seen as initiating a pioneering effort in applying contemporary tawarruq according to certain systems, regulations, instructions and procedures that must be adhered to ensure its compliance with the Shariah – as intended by its regulators. Subsequently, the application of tawarruq in that market will be analysed according to the necessary Shariah standards in order to explain the prevalence of Shariah compliance governance in that market and in order to identify the Shariah related issues regarding the matter as well as finding the proper solutions to address these issues. ******************************************************** Kajian ini membincangkan tentang permasalahan kerajaan patuh syariat dalam perlaksanaan konsep jual beli tawarruqdi institusi-institusi kewangan kontemporari serta jalan penyelesaiannya mengikut lunas syariat. Hal ini penting memandangkan tawarruqadalah salah satu akad syariat yang menjadi asas kepada terhasilnya produk-produk dan instrumen bank kontemporari. Menggunakankaedah induktif,Bursa Malaysia dipilih sebagai kes kajian. Pemilihan ini berasaskan kepada peranan yang dimainkan oleh Bursa Malaysia itu sendiri sebagai peneraju dalam bidang perlaksanaan tawarruqkontemporari,selain kesediaanya darisegi sistem,garis panduan,prosedur tertentu yang perlu diikuti bagi merealisasikan kerajaan patuh syariat seperti mana yang diharapkan. Selain kaedah induktif,kaedah analisa juga digunakan melalui analisa terhadap perlaksanaan-perlaksanaan konsep tawarruqdi Bursa Malaysia dalam kerangkan syariat Islam. Ini bagi menjelaskan sejauh mana kedaulatan kerajaan patuh syariat dalam Bursa tersebut. Selain itu,diharapkan juga kajian ini dapat mengenalpasti permasalahan berkenaan hukum-hukum syariat berkenaan hal ini serta mencari jalan-jalan penyelesaiannya. Melalui kajian ini,pengkaji mengharapkan agar dapat menemui beberapa dapatan sebagai contoh mengadakan jual beli sebenar serta mengelak kemungkinan wujud unsur riba serta penipuan dan lain-lain dapatan.
