Abstract

From Shariah to Statute: Legal and Regulatory Framework of Islamic Finance in Malaysia provides a comprehensive and reader-friendly overview of how Islamic finance is regulated within Malaysia’s unique dual legal system. It explains the relationship between Shari’ah principles and statutory law, highlighting the roles of key regulatory authorities, core legislation, and institutional mechanisms that uphold Shari’ah compliance, financial integrity, and consumer protection. The book covers a wide spectrum of legal domains underpinning the Islamic financial services industry in Malaysia. These include the laws governing Islamic banking, Takaful, and the Islamic capital market, as well as the Labuan offshore Islamic financial framework for Shari’ah-compliant cross-border business. It also examines dispute resolution mechanisms, including court procedures and alternative dispute resolution (ADR) frameworks. In addition, the book discusses recent regulatory advancements, including the licensing and supervision of digital Islamic banks and digital Takaful operators, along with Malaysia’s ongoing efforts to promote sustainability, innovation, and legal harmonisation across the Islamic finance ecosystem. With its detailed treatment of legal instruments, regulatory structures, and Shariah governance mechanisms, this book serves as a valuable reference for students, academics, practitioners, regulators, and anyone seeking a deep understanding of Malaysia’s integrated approach to regulating Islamic finance.
