Abstract

Cyber law is crucial to the effectiveness, efficiency and sustainability of commercial activities via cyberspace. The role can be explained in a three-prong significance: firstly, cyber law helps establish the legality and admissibility of contracts, communications and promises made electronically or using digital methods such as those made on websites, social media, via e-mails, mobile apps or any digital platforms. Secondly, cyber law ensures that all relevant rules and principles of fairness and justice that protect people in commercial activities are equally recognised and available to traders and consumers online, this includes rights of consumer protection as well as the right to data privacy. Thirdly, cyber law ensures the reliability, integrity and security of the electronic system and infrastructure used for commercial activities. In this chapter, we examine some aspects of those cyber laws that seek to serve the above roles in the context of Malaysia. It discusses them in three different sections. As for the legality and admissibility of electronic contracts and communications, this chapter looks at the Electronic Commerce Act 2006 (Act 658). In the subsequent section, the chapter examines the rights of consumers in e-commerce as prescribed under the Consumer Protection Act 1999 (Act 599). Lastly, the chapter elaborates the general provisions that regulate personal data processing as provided in the Personal Data Protection Act 2010 (Act 709).
