Abstract

الأسرة المسلمة كيان يقوم على مقومات وثوابت نصّت عليها الشريعة الإسلامية من خلال مجموعة من الأحكام الشرعية المتعلقة بباب النكاح في الفقه الإسلامي، والتي تنتظم في جملة من المحددات تمثل في مفهومها الشامل أركانا وركائز ثابتة يقوم عليها نظام العلاقات الأسرية على مستوى الأزواج والأبناء والأقارب والأرحام والأصهار؛ وتعد هذه المحددات المفاهيمية محترزات جامعة ومانعة في حفظ مقومات الأسرة الذي يواجه في عصرنا تحديات كثيرة؛ ومنها تحدي الاتجاه الحداثي الذي يحاول من خلال إعماله المنهج التفكيكي الوصول إلى مفاهيم لا تراعي في ذلك اعتبار المتقرر الثابت من الأصول و الضوابط الثابتة في فهم النصوص الشرعية الإسلامية، الأمر الذي يترتب عليه تفويت مقاصد أحكام الأسرة المسلمة وظهور مفاسد تعود على المكلفين بخرم علاقاتهم الأسرية وعلى المجتمع الإسلامي في إضعاف تماسك نظامه، من هذا المنطلق تكمن مشكلة البحث في مدى أهمية تفعيل مقاصد الأسرة المسلمة باعتبارها معايير ثابتة في ضبط المفاهيم التشريعية في النصوص وفي جعل تلك المفاهيم محددات منهجية من شأنها أن تحفظ الأسرة ممّا قد يدخلها من فساد الفهم والتأويل والتعطيل، ويأتي البحث في هذا الموضوع في سياق مواجهة ما تتعرض له ثوابت الأسرة من تحديات منهج التفكيك الحداثي، و هذا ما دفع الباحثتين إلى تناول الموضوع بالدراسة في ضوء مقاصد الشريعة الإسلامية، اعتمادا على المنهج الاستقرائي في تتبع لمادة البحث من مصادرها ومراجعها المناسبة، وأيضا على المنهج التحليلي الذي تقتضيه معالجة طبيعة الإشكالية المطروحة ومناقشتها ، وتوصلت الدراسة إلى جملة من النتائج؛ أهمها بيان المحددات المفاهيمية التي ترتكز عليها أحكام الأسرة المسلمة، و تتميز تلك المحددات في أهميتها بكونها مقومات ثابتة وتكتسب قوة معياريتها من الأصول المقاصدية التي تستند إليها؛ وهذا ما يجعلها في أبعادها المنهجية لها أهميتة في الحفاظ على الأحكام الشرعية للأسرة المسلمة مما تواجهه من تحديات التفكيك في الاتجاه الحداثي. ***** The Muslim family is an institution founded on principles and constants stipulated by Islamic Sharia through a set of legal provisions specific to the chapter of marriage in Islamic jurisprudence. These provisions converge within defined boundaries, constituting pillars and foundations in its comprehensive concept, represented by marital relations, children, relatives, in-laws, and kinship. These boundaries serve as cohesive and preventive measures in the understanding of the family, which faces the challenges of the modernity trend through its analytical approach, applied according to a perspective that contradicts the application of Islamic Sharia. This leads to the neglect of the purposes of the Muslim family's laws and the emergence of harms affecting the responsible individuals and the Islamic community. From this perspective, the research problem lies in assessing the extent to which the preservation of the Maqasid of the Muslim family, as outlined by Islamic Sharia, is achieved by defining and clarifying its concepts in the face of the challenges posed by the deconstructive approach. This prompted the researchers to address the topic through a study in light of the Maqasid of Islamic Sharia, relying on the inductive method to follow the research material, in addition to the analytical method required by the nature of the presented problem. This approach aims to achieve the desired results in preserving the legal provisions of the family and its Maqasid, integrated within the defined boundaries, in opposition to the challenges of deconstruction in the modern trend.
