Abstract

يتناول هذا البحث المنظومة الأخلاقية في الدرس التراثي الفقهي والمقاصدي بإبراز مركزيتها، وبيان الترابط والتداخل بين الأخلاق وعلمي الفقه والمقاصد، والهدف من ذلك تفعيل الأخلاق وإعادة اعتبارها اعتبارًا جليًّا يظهر في الأفعال والنيات والقصود عملاً وعلة وغاية، وقد توسَّل البحث المنهج الاستقرائي والتحليلي في الكشف عن أهمية الأخلاق وعلاقتها بالفقه والمقاصد، وتحليل الخلاف في أقوال المتقدمين والمعاصرين وآرائهم في الفصل والوصل بين الفقه والأخلاق، ومرتبة الأخلاق في الترتيب المقاصدي لسلم المقاصد، وتوجيه ذلك بنقد بعض الأفكار والتوفيق بين بعضها الآخر، ليخلص البحث إلى مركزية الأخلاق وأساسها الضروري متمثلة في روح الدين وثمرة التدين، وأن الفقه وما اشتمل عليه من أحكام تتحدد قيمتها بقيمة الأخلاق المنطوية تحتها وتنعدم بانعدام الأخلاق، وأن الغاية الخلقية هي المقصد الشرعي من التكاليف الشرعية، ووسيلة إلى السعادة الأبدية، وجماع ذلك العمل بمقتضى التخلق بصفات الرحمن والاقتداء بأفعاله. _________________________________________________________ This research deals with the ethical system in the traditional study of jurisprndence and Maqasid by highlighting its centrality and clarifying the aspects of interdependence and overlap between ethics and the sciences of jurisprndence and Maqasid. The aim of the research is to activate ethics and re-consider them in a clear way that appears in actions, intentions and purposes as act, cause and goal. The research relied on the analytical inductive approach in tracing and revealing the importance of ethics and their relationship to jurisprndence and Maqasid. Also, to analyze the disagreement in the sayings and opinions of the predecessors and contemporaries in the aspects of separation and connection between jurisprndence and ethics and the rank of morals in the intentional arrangement of the ladder of Maqasid and directed that by criticizing some ideas and reconciling some of them. The research concluded that the centrality of ethics and its necessary basis is represented in the spirit of religion and the frnit of religiosity, and that jurisprndence and the provisions it contains are valued by the value of ethics implicit in it and nullified by the lack of ethics. Beside that the moral goal is the legitimate aim of legal obligations and a means to eternal happiness, and to achieve that is to be acting in accordance of the morality of the Most Gracious attributes and follow his actions.
