Abstract

تتناول هذه الدراسة الخصائص المنهجية للبيان التشريعي في القرآن الكريم من خلال دراسة موضوعية مقاصدية تستهدف الكشف عن الأسس التي يقوم عليها الخطاب التشريعي القرآني في بناء الأحكام وتوجيه الإنسان والمجتمع. وتتمثل إشكالية البحث في أن كثيرًا من الدراسات الفقهية والقانونية تناولت الأحكام الشرعية من منظور جزئي أو تقليدي، دون إبراز المنهج القرآني المتكامل في عرض التشريع وما ينطوي عليه من أبعاد مقاصدية وتربوية ونفسية واجتماعية تكشف عن حكمته ومرونته وصلاحيته لكل زمان ومكان. ويهدف البحث إلى بيان خصائص هذا المنهج التشريعي والكشف عن مقاصده الكلية وأثره في بناء الفقه الإسلامي وترشيد الاجتهاد المعاصر. واعتمدت الدراسة المنهج الاستقرائي في تتبع الآيات التشريعية في القرآن الكريم، والمنهج التحليلي المقاصدي في دراسة أساليب البيان التشريعي واستنباط دلالاتها وأبعادها الوظيفية. وتوصلت الدراسة إلى أن القرآن الكريم يتميز بمنهج فريد في عرض الأحكام يقوم على الوضوح والدقة، ويجمع بين الحزم في الأحكام القطعية والمرونة في القواعد العامة، بما يفتح مجال الاجتهاد المنضبط. كما تبين أن الخطاب التشريعي القرآني يربط الأحكام بالترغيب والترهيب والثواب والعقاب، ويعتمد التدرج في التشريع والتعليم، ويراعي أحوال الناس النفسية والاجتماعية، مع بيان الحكم والمصالح المترتبة على الأحكام. وأظهرت النتائج كذلك تكامل التشريع القرآني وترابطه مع العقيدة والعبادة والأخلاق والمعاملات في إطار مقاصدي قائم على العدل والحكمة والرحمة. وأوصت الدراسة بالإفادة من المنهج التشريعي القرآني في تجديد الدراسات الفقهية والمقاصدية، وتفعيل البعد التربوي والإيماني في الخطاب الفقهي، وبناء اجتهاد معاصر يوازن بين الثوابت والمتغيرات. وتتمثل أهميتها في إبراز شمولية البيان التشريعي القرآني بوصفه منهجًا ربانيًا متكاملًا يجمع بين الهداية والتشريع والتربية والإصلاح الحضاري. Abstract This study explores the methodological characteristics of legislative discourse in the Qur’ān through a thematic and maqāṣid-oriented approach. It addresses the problem that many legal and juristic studies have focused on individual rulings without adequately examining the Qur’ān’s integrated legislative methodology and its educational, social, psychological, and maqāṣid dimensions. The study aims to identify the distinctive features of Qur’ānic legislative discourse, uncover its higher objectives, and demonstrate its role in shaping Islamic jurisprudence and guiding contemporary ijtihād. The research employs an inductive method by surveying legislative verses throughout the Qur’ān and a maqāṣid-based analytical method to examine their modes of expression and underlying purposes. The findings reveal that the Qur’ān presents legislation through a unique methodology characterized by clarity, precision, and balance between firmness in definitive rulings and flexibility in general principles that allow for juristic reasoning. Qur’ānic legislation does not merely convey commands and prohibitions; rather, it connects them with themes of encouragement and warning, reward and accountability, thereby strengthening the spiritual and educational dimensions of legal compliance. The study also highlights the Qur’ān’s reliance on gradualism in legislation and instruction, its consideration of human psychological and social circumstances, and its emphasis on the wisdom and benefits underlying legal rulings. Furthermore, Qur’ānic legislation is shown to be an integrated system linking creed, worship, ethics, and social transactions within a framework grounded in justice, wisdom, and mercy. The study recommends utilizing the Qur’ānic legislative methodology in renewing contemporary juristic and maqāṣid studies, strengthening the educational dimension of legal discourse, and developing balanced forms of ijtihād capable of addressing modern challenges while remaining faithful to the objectives and principles of Islamic law
