Abstract

Islamic banking aspires to become a force with a significant impact on the level of the economy of countries by providing products that are developing remarkably in Islamic countries in general, and in Muslim minority countries in particular, as a lifeline for Muslims from the monopoly of traditional banks on financial transactions. This research aims to clarify the practice of Mudaraba in An-Noor Islamic Window and its adequacy for the needs of the Muslim minority in Sri Lanka in the light of the objectives of Shari’ah . The research included three sections; The first topic dealt with an introductory overview of Islamic banking and Islamic windows in Sri Lanka. As for the second topic, it attempts to discuss the Mudaraba contract implemented in An-Noor Islamic Window. The third section analyzes whether the needs of the Muslim minority in Sri Lanka in financing is sufficiently fulfilled in the light of the objectives of Shari’ah. The research adopts the inductive method in tracing the scientific material from its appropriate sources and references, the analytical method in explanation, inferences and discussion. The research reached to achieve several results, the most important of which are: Mudaraba practiced in An-Noor Islamic Window still needs to be developed in its mechanisms by obtaining experiences from the Mudaraba contract followed in successfully established countries. Mudaraba practiced as a banking product in An-Noor Islamic Window does not meet the developmental needs of the Muslim minority in the dimensions of social, health and educational purposes. An-Noor Islamic window should work to gain the confidence of Muslims more, in terms of raising efficiency in Shari’ah governance, especially in Shari’ah auditing.
