Abstract

تناول هذا البحث مسألة هامة من مسائل الإجماع؛ وهي مدى اعتبار مخالفة الواحد للإجماع، فهذه المسألة اختلف فيها العلماء على عدة آراء، فكان رأي الجمهور هو اعتبار مخالفة الواحد للإجماع بضوابط محددة، فرأى الباحث أن يُشر إليها بمزيد من البيان، موضحًا أهم آداب هذه المخالفة. ثم قام الباحث ببيان ثمرة الخلاف الأصولي في مسألة مشروعية رمي الجمرات قبل الزوال، وبنيَّ كيفية تطبيق هذه المسألة فيها. وتنبعأهمية هذا البحث في الاهتمام بآراء بعض المنفردين التى اعتبرت شاذة في عصر ما، وقدتصلح للاعتبار في عصور وظروف أخري، كذلك من ضرورة الاحتراز عن إطلاق وصف الإجماع على مسائل مختلف فيها، وكنتيجة لاستثمار الخلاف الأصولي في مسألة رمي الجمرات قبل الزوال لما فيها من مراعاة مقصد حفظ النفس. واتبع الباحثُ المنهجيَّ الاستقرائي بجمع المادة العلمية من مصادرها، ثم المنهج التحليلي بتحليلها، ومحاولة استنتاج نتيجة، وهي ضوابط اعتبار مخالفة الواحد للإجماع، كذلك تحليل آراء العلماء في مسألة رمي الجمرات قبل الزوال وتخريجها على مسألة اعتبار خلاف الواحد للإجماع ،والوصول إلى الرأى الراجح. وأهم ما توصل إليه الباحثُ هو اعتبار خلاف الواحد للإجماع بضوابط محدد ة، وإمكانية الجمع بيَّ القوليَّ، فيكون رمي الجمرات بعد الزوال أولى بالاتباع، مع جواز الرمي قبل الزوال أخذًا برأي الأقل لما فيه من رفع المشقة والتيسير على الحجاج. وأهم ما يوصي به الباحث هو إعادة النظر في مسائلكثيرة حُكى فيها الإجماع ولها مخالف قد يعتبر رأيه في زمان ومكان آخرين، كذلك عدم الإنكار على من اتبع رأى جواز الرمي قبل الزوال. ************ This research explained an important issue of Ijma', namely the extent to which consider the mujtahid disagreement to Ijma'.The scholars have been disagreeing in this issue into several opinions,the majority believed in considering one disagreement to Ijma' with specific regulations which the researcher tried to explain, also to explain manners of this disagreement, then he explained the conclusion of Usuli difference in the extent to which it is permissible to throw stones before the meridian, and indicate how this issue is applied there. The importance of this research stems from interest in opinions of some individuals that were considered abnormal in one era, and may be considered in other times and circumstances, as well as from the need to guard against general description of Ijma' on disputed issues.The researcher followed the inductive approach by collecting the scientific material from its sources, then the analytical method by analyzing it, and trying to conclude a result, which is the regulations of considering the disagreement of the one for Ijma' ,as well as analyzing the opinions of scholars on the issues of throwing stones at the meridian and applying it on the issue of considering the disagreement of one to Ijma'.The most important thing thaT the researcher reached is considering the disagreement of one to Ijma' with specific regulations, as well as Possibility of merge between the two opinions: the prohibition of throwing stones before the meridian has the priority to follow, while throwing stones before the meridian is permissible with persons have excuses following minority opinion because of its misery alleviation and for hajjis comfort. The most important thing that the researcher recommends is reconsidering of many issues in which Ijma' has been told with the presence of disagreer that may consider his opinion at another time and place, Likewise, there is no blaming for those who followed the opinion of permissibility of throwing before the meridian.
