Abstract

Artikel ini mengetengahkan perihal jerebu rentas sempadan di Malaysia yang berpunca daripada pembakaran hutan di Indonesia. Beberapa aspek dinilai di dalam artikel ini termasuklah faktor dan impak jerebu kepada Malaysia, isu dan cabaran pencemaran rentas sempadan serta peruntukan undang-undang Malaysia yang berkait rapat dengan masalah jerebu rentas sempadan dalam usaha mengekalkan kualiti udara pada paras baik. Artikel ini bertujuan untuk mengkaji rangka kerja perundangan semasa Malaysia dalam menangani pencemaran jerebu rentas sempadan selain mengupas fungsi Perjanjian ASEAN Mengenai Pencemaran Jerebu Rentas Sempadan 2002 dalam menangani masalah ini. Artikel ini menggunakan kaedah penyelidikan kualitatif menerusi penilaian deskriptif dan analisis kritikal terhadap peruntukan undang-undang yang relevan buat Malaysia dalam menghadapi fenomena jerebu rentas sempadan. Hasil penyelidikan menyimpulkan bahawa peruntukan undang-undang Malaysia hanya memadai untuk mengawal masalah pencemaran jerebu domestik dan perlu ditambah baik untuk mengatasi masalah jerebu rentas sempadan. ****************************************************************** This article highlights transboundary haze pollution in Malaysia that resulted from forest fires in Indonesia. Several aspects are analysed in this article including the factors and impacts of haze on Malaysia, the issues and challenges of transboundary pollution, and Malaysian laws provision regarding transboundary haze pollution in an effort of maintaining good air quality. This article aims to examine the current legal framework of Malaysia in dealing with transboundary haze pollution as well as the functions of the ASEAN Agreement on Transboundary Haze Pollution 2002 in addressing this problem. This article uses qualitative research methods through descriptive assessment and critical analysis of the relevant provisions of Malaysian law in facing the transboundary haze phenomena. The study finds that the provisions of Malaysian law are only sufficient to control the domestic haze pollution problem and need to be improved to address transboundary haze pollution problems.
