Abstract

الدلالة النحوية لها علاقة وثيقة بالحكم الشرعي بحيث أنها تؤثر في استنباط الأحكام الشرعية. وتتم هذه العلاقة على أساس أن النحو من المواد التي يقوم عليها علم أصول الفقه، كما أ ّن التعمق في النحو من شروط مهمة للمجتهدين في الأحكام الشرعية. وتهدف المقالة إلى دراسة الدلالة النحوية التي تؤثر في استنباط الأحكام الشرعية دراسًة وصفيًة،كما تعتمد الدراسة على الكتب المهمة في الربط بين النحو العربي والحكم الشرعي مثل الكوكب الدري في تخريج الفروع الفقهية على المسائل النحوية للأسنوي، وأثر الدلالة النحوية واللغوية في استنباط الأحكام من آيات القرآن التشريعية للسعدي، وغيرهما. ومن أهم نتائج توصل إليها الباحث أن دلالة الحروف لها أثر واضح جل ّي في الأحكام الشرعية. *********************************************************** Dilalah (petunjuk) nahu mempunyai perkaitan yang sangat rapat dengan hukum syarak, yang mana ianya memberi kesan dalam penetapan hukum syarak. Hubungan ini berdiri di atas asas bahawa ilmu Nahu merupakan salah satu dari sumber yang sangat penting dalam bidang usul fiqh sebagaimana pengetahuan yang mendalam dalam ilmu nahu menjadi syarat utama ahli ijtihad dalam menetapkan hokum syarak. Justeru, tujuan penulisan ini ialah untuk mengkaji Dilalah Nahu yang memberi kesan dalam penetapan hukum syarak melalui kajian secara deskriptif dengan merujuk kepada rujukan penting dalam menghubungkan antara ilmu Nahu dan hokum syarak, iaitu Kitab karangan Imam Asnawi yang bertajuk Al-Kaukab Al-Durri Fi Takhrij Al-Furu’ Al-Fiqhiyah, Kitab karangan Imam Al-Saadi yang bertajuk Athar Al-Dilalah AlNahwiyyah Wal-Lughawiyah Fi Istinbat Al-Ahkam. Antara dapatan utama kajian ialah dilalah huruf merupakan dilalah yang paling ketara kesannya dalam penetepan hokum syarak. ********************************************************** The grammatical (syntaxs) significance is closely related to the Islamic Hukm so that it influences the determination of Shari'a Hukm. This relationship stands on the basis that the knowledge of Nahu is one of the most important sources in the field of Usul Fiqh as profound knowledge of the knowledge of grammar is the main requirement of ijtihad members in the determination of Shari'a Hukm. Hence, the aim of the article is to study the grammatical significance that influences the determination of Shari'a Hukm descriptively based on the important books which discuss properly relation between Arabic grammar and Shari'ah Hukm, Al-Kaukab Al-Durri Fi Takhrij Al-Furu’ Al-Fiqhiyah, written by Imam Asnawi and Athar Al-Dilalah Al-Nahwiyyah Wal-Lughawiyah Fi Istinbat Al-Ahkam written by Imam Al-Saadi. One of the most important conclusions reached by the researcher is that the significance of huruf has a clear effect in the determination of Shari'a Hukm.
