Abstract

يتناول هذا البحث دراسة بعض القضايا المتعلقة بوسائل تطور الفكر التشريعي المعاصر؛ فرغم وجود مجالس إفتاء جماعي في البلاد المسلمة من جهة؛ ومحاولات فردية لمن لهم مؤهلات الاجتهاد والإفتاء من جهة أخرى؛ لكن تبقى مساهماتهم محدودة جدا، ولاتفي بالغرض المنشود في إيجاد حلول شرعية مناسبة لما تعرفه الأمة من إشكالات وتحديات. الأمر الذي يطرح للدراسة إشكالية "القصور" الإبداعي في هذا المجال من التخصصات العلمية الأساسية في حياة المسلمين. بناء على ما سبق، وبمقتضى منهجي يجمع بين الاستقراء والتحليل؛ يتعرض البحث في محاوره لبيان مفهوم الإبداع و التأصيل لمشروعيته وأهميته ومجاله في الفكر الاجتهادي التشريعي وأهمية اعتبار مقاصد الشريعة الإسلامية في تحققه، ثم يتناول دراسة أهمّ الأسباب المختلفة التي لها الأثر الكبير فيما هو عليه حال "مناهج التعليم الديني" من قصور يتعلق بالسياسة التعليمية وبالعملية التعليمية ذاتها مثل بعض سلبيات الاقتصار في التكوين الشرعي على علم دون آخر؛ و القصور في بعض طرق التدريس و فيما تتضمنه الكثير من المقررات من مادة علمية تحتاج إلى تطوير يجمع في الاعتبار بين مقاصد التشريع و ما تتطلبه مستجدات العصر. و الهدف من دراسة أسباب القصور و عرض بعض التجارب الرائدة في معالجتها؛ هو تفعيل التعليم الديني نحو تحقيق أهدافه في نهضة الصناعة التشريعية وتطور أدائها الرسالي الحضاري في كل مجالات الحياة ؛ وهو الأمر الذي جعل رواد الإصلاح المعاصر أمثال الشيخ محمد عبده و الشيخ رشيد رضا والشيخ ابن عاشور وابن باديس وعلال الفاسي وغيرهم .. يجمعون على أهمية إصلاح نظم التعليم كدعامة أساسية وأوليّة للنهوض بحال الأمة. This research discusses various issues in relation to the means and challenges of contemporary legal thought. Despite the existence of consultative councils (majÉlis iftÉ’) in Muslim countries from one perspective and presence of individual efforts by those capable of ijtihÉd and issuing fatwÉ (iftÉ’) from another, their contributions are still limited and does not meet the ends. This poses legitimate questions on factors and causes leading to failure of creativity in basic scientific disciplines that are important in the lives of Muslims. This problem requires an academic study that can answer the aforementioned questions in order to construct solutions. This research combines between inductive and analytical methods and commences with the concept of creativity, its legitimacy, its importance, its role in Islamic legal thought, and importance of considering SharÊʿah objectives in order to establish creativity. The study then discusses the incapability of the current “religious curriculum” that fell short in producing creative skills. This failure disabled the curriculum to deliver civilizational message in all aspects of life namely thought, culture, society, economics, politics, and contemporary science. This deficiency led Muslim pioneers of contemporary Islamic thought such as MuÍammad ʿAbduh, RÉshid RiḍÉ, Ibn ʿAshūr, Ibn BadÊs, ʿAllÉl al-FÉsÊ, and others to consensually agree on the importance of reforming the education system as one of the primary pillar to improve the state of the ummah.
