Abstract

تحتلُّ الأدلة الشرعية في علم أصول الفقه مكانةً مرموقةً حيث تُجعَل موضوع هذا العلم الذي يرجع إليه سائر المباحث الأصولية. وتظهر أهمية العلم بهذه المكانة في علاقة الأدلة الشرعية بالموضوعات الأخرى في علم أصول الفقه وأثر هذه العلاقة في تطبيق أصول الفقه في الاستدلال والاجتهاد. ويحاول هذا البحث إبراز جوانب هذه العلاقة مع بيان الآثار الأصولية المترتبة عليها في فهم تناسق مباحث علم الأصول وتعاضد بعضها بعضًا. وتعتمد هذه الدراسة على المنهج الاستقرائي في جمع المعلومات والأفكار من مواضيعها ومصادرها الصحيحة، وكما تعتمد على المنهج التحليلي في نقد ما تمَّ إلمامه من المعلومات ومراجعته. وتتكوَّن هذه الورقة على مقدمةٍ وثلاثة ِمباحث وخاتمةٍ إذ يتناول المبحث الأول موضوع ترتيب الأدلة ويتطرَّق المبحث الثاني إلى موضوع تأصيل الأدلة ويتعرَّض المبحث الثالث لموضوع توظيف الأدلة. The Islamic legal evidences hold the highest position in the discipline of Islamic Jurisprudence where they are considered as the subject matter of this discipline, which other topics are relying on them. The importance of knowing the position of Islamic legal evidences can be shown in the correlation between these evidences and the other subjects in this discipline as well as in the implication of this correlation on the application of Islamic Jurisprudence in deduction of legal rulings and Ijtihad. This study attempts to point out the theoretical sides of this correlation by demonstrating the implications of the correlation on understanding relationship among the topics of Islamic Jurisprudence. This study relies on two methods, which is the inductive methodology in collecting related data and analytical methodology in studying collected data. This study consists of an introduction, there chapters and a conclusion, where the first chapter addresses the subject of prioritization of legal evidences, the second chapter tackles the subject of underpinning of legal evidences, and the third chapter handles the subject of application of legal evidences.
