Abstract

سعى البحث إلى استجلاء قضية الاختلاف الفقهي بين المدح والذم، وذلك في دراسة تقويمية في ضوء الكتاب والسنة. وينقسم البحث إلى مقدمة، ومبحثين، وخاتمة. تناول البحث في المبحث الأول مفهوم الاختلاف الفقهي، وأوضح أن ثمَّة فرقا بين كلمتَي (الاختلاف) و(الخلاف)، فالأوَّل ما يبنى على دليلٍ، والثاني ما أسس على غير دليل. كما استعرض لمحة تاريخية عن أطوار الاختلاف الفقهي. وقد جلَّى البحث في المبحث الثاني انقسام الفقهاء إلى اتجاهين إزاء قضية الاختلاف الفقهي، وأبان أدلة الاتجاهين، اتجاه يمدحه ويرى أنه تطبيق لمبدأ التيسير الذي جاء به الإسلام، وأن طبيعة النصوص الشرعية تقتضي هذا الاختلاف. في حين ذهب آخرون إلى ذمِّ الاختلاف، وعدِّه ضررًا على المسلمين، وبعد عرض أدلة الاتجاهين وتقويمها تبدَّى أنَّ الاختلاف الفقهي بمنأىً عن مرتع النزاع؛ إذ الكل مقر بأن الاختلاف في المسائل الفقهية الفرعية واقعٌ، وأنه أمر فطري، بيدَ أن المذموم من الاختلاف ما كان مبنيًا على الهوى، أو أفضى إلى التفرق، ولم يسعفه الدليل الصحيح، ولم يخالف في ذم هذا النوع من الخلاف علماء السلف والخلف. This research attempts to reveal the differences between the agreement and disagreement of the discrepancy in Fiqh. It is an evaluation study in the light of Quran and Sunnah.The study consists of an introduction, two chapters and a conclusion. The first chapter discusses the concept of differentiation in Fiqh. Secondly, it shows the dissimilarity between the two words (Ikhtilaf-difference) and (khelaf-dispute). Then, it demonstrates the historical overview of the variance Fiqh phases. The second chapter, involves the stand of the jurists about this issue and as a result the jurists are divided into two groups, praises the differences in Fiqh due to requirements of the Sharia texts. On the other hand, the second group disagrees with the issue. At the end, the results have been declared significantly.
