Abstract

Mutakhir kini, kahwin lewat telah menjadi suatu fenomena yang semakin membimbangkan masa depan negara membangun seperti Malaysia. Beberapa pendekatan telah dilakukan oleh pihak-pihak berwajib dalam usaha menyelesaikan permasalahan ini. Salah satu pendekatan kontroversial yang telah dicadangkan adalah dengan melaksanakan poligami. Pada asasnya, perkahwinan telah disyariatkan dalam Islam dengan jelas. Demikian juga pensyariatan poligami ada dinyatakan dalam al-Quran dan al-Sunnah sebagai solusi kepada permasalahan tersebut, bukan sebagai punca kepada masalah. Oleh itu, kertas kerja ini akan menganalisis keboleh-laksanaan poligami sebagai usaha menyelesaikan masalah kahwin lewat. Penyelesaian ini adalah hasil kajian ke atas Tafsir al-Qur’ān, nas-nas ḥadīth dan athār serta praktikalnya ke atas masyarakat berdasarkan perspektif undang-undang. The phenomenon of over-aged unmarried women has been widely spread over Muslim society in Malaysia which unfortunately leads to negative impact to the future of our nation building and sustainable development. Several attempts have been put forward by the stakeholders to solve such a phenomenon, one of the solution suggested is by practicing polygamy. The practice of polygamy is sanctioned in the Qur’ān and Sunnah, and it has been proven a solution to the many societal problems, not a source of the problems. This paper attempts to analyze the role of polygamy in solving the problem of over-aged unmarried women, based on its legislation in the Qur’ān and its interpretation, the Sunnah and the traditions of the companions and the following generation of scholars. It will also be analyzed from the legal perspective of its practice within the society.
