Abstract

تناولت هذه الدراسة بيان أثر الفقهي لقاعدة: الأمر المطلق يقتضي الوجوب عند الإمام البغوي. وقد اشتملت الدراسة على ثلاثة محاور. أما الدور الأول فهو في التعريف بالإمام البغوي رحمه الله. واما المحور الثانِي فقد ذكر فيه المواضيع التي أورد البغوي هذه القاعدة من كتبه، ثم دراسة القاعدة من كتبه وبينا اتفاق العلماء في اان صيغة الأمر إذا اقترنت بقرينة وبينا على ما تفتضيه القرينة من وجوب او غيره. وخلافهم في الأمر المطلق المجرد عن القرائن. وأما المحور الثالث ولْخير فهو في بيان أثر الفقهي لقاعدة: الأمر المطلق يقتضي الوجوب عند الإماـم البغوي. وقد ذكرنا فيه خمس مسائل الفقهي التي لها أثر على القاعدة. ***** This study examines the jurisprudential impact of the rule: an absolute command implies obligation according to Imam Al-Baghawi. The study consists of three main sections. The first section provides an introduction to Imam Al-Baghawi. The second section mentions the instances where Al-Baghawi applied this rule in his books, and discusses the rule itself, It explains the consensus among scholars that if a command form is accompanied by a contextual indication, it should be understood according to that context, whether it implies obligation or otherwise. It also covers the differences of opinion regarding an absolute command devoid of any contextual indications. The third and final section outlines the jurisprudential impact of the rule: An absolute command implies obligation according to Imam Al-Baghawi, detailing five jurisprudential issues influenced by this rule.
