Abstract

يهدف هذا البحث إلى الوقوف على دلالة المشترك الأصولية، فيؤصل لقواعده، ثم يجمع إليها الفروع الفقهية التي نشأت بناء على تلك القواعد، هذا وإن مسألة المشترك من أهم المسائل الأصولية اللغوية، التي لها فروع فقهية كثيرة، ومن هنا تكمن مشكلة البحث؛ إذ تتلخص في الوقوف على دلالة المشترك من الناحية الأصولية ثم الفقهية، فجاء البحث ليجيب على الأسئلة الآتية: ما معنى المشترك في كل من اللغة والاصطلاح؟ وما أقوال العلماء في وقوعه؟ وما إمكانية استعماله في معانيه؟ وما ضوابط ذلك؟ وما أقسام المشترك؟ وقد استعمل البحث كلًا من المنهج الاستقرائي والتحليلي، وتوصل إلى نتائج لعل من أهمها: أن ‌المشترك: هو ما تعدد معناه واتحد لفظه، وأن الراجح أن المشترك جائز الوقوع، وواقع، وأن استعماله في معنييه ممكن إذا لم يمتنع الجمع، وأن للمشترك عدة أقسام، فمشترك في الاسم والفعل والحرف، ومشترك أمكن اجتماع معنييه وآخر لم يمكن، وتقسيم ثالث وهو مشترك تجرد عن القرينة، وآخر وجد قرينة ترجح أحد معانيه. ***** This research aims to stand on the significance of the common fundamentalism, so it originates its rules, and then gathers to it the jurisprudential branches that arose based on those rules. It is summarized in standing on the significance of the common in terms of fundamentalism and jurisprudence, so the research came to answer the following questions: What is the meaning of the common in both language and terminology? What are the sayings of scholars about it? What is the possibility of using it in its meanings? What are the controls for that? What are the subscriber categories ? The research used both the inductive and the analytical method, and reached results, perhaps the most important of which are: that the common: is that which has multiple meanings and its word is united, and that the most correct is that the common is permissible and real, and that its use in its two meanings is possible if the combination is not precluded, and that the common has several divisions, So, there is a participant in the noun, the verb, and the letter, and a participant whose meanings could be combined, and another that was not possible, and a third division, which is a participant stripped of the context, and another that found a context that favors one of its meanings.
