Abstract

في العصر الحالي، أصبحت مسألة مخاطر التمويل أمرًا بارزًا، خاصة مع وجود المؤسسات المالية التي تقدم خدمات التمويل. وتشدد الشريعة الإسلامية على تجنب المخاطر من خلال اتخاذ الاحتياطات، المعروفة باسم الاحتياطات العرفية، كجزء أساسي من الاعتماد على إرادة الله. يظهر التكافل، أو التأمين الإسلامي، كوسيلة مستخدمة لتقليل مخاطر التمويل. يعتمد هذا البحث على منهج نوعي، حيث يتم تحليل البيانات من مصادر متنوعة مثل مواقع الشركات الرسمية والأوراق البحثية وتشريعات الحكومة. تشير النتائج إلى شرعية مختلف أنواع التكافل في معاملات الأمور المالية الإسلامية، وصحة العقود المستخدمة في هذه المعاملات، وضرورة معالجة المشكلات، خاصة تلك المتعلقة بالعقود. ***** In the contemporary era, the risk associated with financing has become a prominent concern, exacerbated by the presence of financial institutions offering financing services. Islamic Sharia emphasizes the avoidance of risks through the adoption of precautions, termed as customary precautions, as an integral aspect of relying on divine providence. Takaful, or Islamic insurance, emerges as a method employed to mitigate the risk associated with financing. This research adopts a qualitative approach, analyzing data from diverse sources such as official company websites, research papers, and government regulations. The findings indicate the legitimacy of various types of takaful in Islamic finance transactions, the validity of contracts employed in these transactions, and the necessity of addressing problems, particularly those related to contracts.
