Abstract

تهدف الدراسة إلى بيان الآليات العقابية التي اتخذتها الشريعة الإسلامية كوسيلة لمكافحة الفساد المالي في أموال المسلمين(المال العام)، ثم مراجعة تطبيق تلك الوسيلة في إطار القوانين العقابية في ليبيا وبيان أبرز النقاط التي تحتاج معالجة وتطوير في ظل النظام العقابي في الشريعة الإسلامية، خاصة أن أغلب القوانين العقابية في ليبيا تواجه النقد في ظل انتشار ظاهرة الفساد المالي ووصولها إلى مستويات قياسية على المستوى المحلي ومراحل متقدمة في المستوى الدولي، استخدم البحث المنهج الاستقرائي لبيان أهم الوسائل العقابية لمكافحة الفساد المالي في الشريعة الإسلامية، كذلك اتبع المنهج الاستنباطي لوضع بعض المقترحات المتعلقة بتطوير التشريعات العقابية لمواجهة الفساد المالي، وقد توصلت الدراسة إلى اتباع المشرع في القوانين العقابية في ليبيا إلى أهم الوسائل العقابية المتبعة في الشريعة الإسلامية، إلا أن الدراسة أظهرت بعض الإشكاليات من خلال المدة الزمنية لإصدار القوانين العقابية، حيث تبين أن التناسب بين الجريمة والعقوبة في القانون الليبي يحتاج إلى إعادة صياغة، كذلك تعدد التشريعات العقابية المعنية بمكافحة الفساد المالي التي تم إصدارها في فترات زمنية متعاقبة خلال فترة النظام السياسي السابق، الأمر الذي يحتاج النظر في إعادة تطوير تلك القوانين بما يلائم النظام القانوني الذي ينسجم مع النظام السياسي، خاصة بعد أن يصدر دستور جديد للبلاد، وقد أوصت الدراسة ببعض المقترحات لتلك الإشكاليات وأهمها دمج التشريعات المتعددة ضمن تشريع واحد يحدد مكانة المال العام ويصف الفعل المجرم ويضع العقوبة الملائمة له. = The study aims to explain the punitive mechanisms taken by Islamic law as a means of combating financial corruption in Muslims (public money), then reviewing the application of that means within the framework of the penal laws in Libya and explaining the most prominent points that need to be addressed and developing under the punitive system in Islamic law, especially that most of the punitive laws in Libya face criticism in light of the spread of financial corruption and its reaching record levels at the local level and advanced stages in the international level. The research used the inductive approach to explain the most important punitive means to combat financial corruption in Islamic law, as well as follow the deductive approach to develop some proposals related to the development of punitive legislation to confront financial corruption. And the study reached the legislator’s followers in the penal laws in Libya to the most important punitive means used in Islamic law, but the study showed some problems through the time period for issuing punitive laws, as it was found that the proportionality between crime and punishment in Libyan law It needs to be reformulated, as well as the multiplicity of penal legislation concerned with combating financial corruption that it was issued in successive periods of time during the period of the previous political system, which needs to be considered re-development of these laws in a way that suits the legal system that is consistent with the political system, especially after a new constitution is issued to the country. And the study recommended some proposals for these problems, the most important of which is the integration of multiple legislation within one legislation determines the position of public money, describes the criminal act and puts the appropriate punishment for it.
