Abstract

The book ‘Equity & Trusts in Malaysia’ which consists of 26 chapters has been contributed by members of the academia who has been involved in the teaching of this subject at various universities in Malaysia and abroad, as well as practitioners who are experts on the subject. The subject of equity encompasses essential topics such as the origin, nature and development of equity; its development in the Malaysian legal system; equitable maxims, assignment, and estoppel; recovering possession of the movable and immovable property; specific performance; other equitable remedies; and the various types of injunctions. Meanwhile, trusts comprise of the origin, nature and development of trust; the various types of trusts such as express trusts, resulting trusts, constructive trusts, secret trusts, charitable and non-charitable purpose trusts, and trusts for commercial purposes; the appointment and discharge of trustees together with their powers and duties; breach of trusts together with the protection and its defences; and variation, revocation and extinction of trusts. The other significant highlights of this book are the principles of equity in Islamic jurisprudence; the application of equity in international law; trusts from the Islamic perspective; and the concept and objective of Waqf. The book is catered for a broad spectrum of readers, the legal and non-legal working community, especially the students pursuing the undergraduate bachelor of laws program, who could benefit immensely from the extensive collections of law, principles and authorities on the subject and thus, without the need for reference to several sources. The chapters have been written in a simple language and the contents are easily comprehendible. At the outset, we, the general editors of this title, would like to express our heartfelt appreciation to all the contributors for their extensive research on the collections of law, principles and authorities. Their research and multifarious knowledge would certainly make this book an excellent source of reference to all those interested in this subject. Our heartiest appreciation and thanks are also due to Tan Sri Dato’ Seri Dr. Syed Hamid Syed Jaafar Albar, Adjunct Professor at the Faculty of Law, National University of Malaysia who was also the former Member of Parliament and who have held various Ministerial portfolio in Malaysia, for spending his invaluable time in preparing the Foreword to this book. Last but not least, we would also take this opportunity to extend our gratitude to the publisher, Sweet & Maxwell Asia, and in particular, Tabitha Dass and her dedicated colleagues for taking a great deal of interest in the publication of this title and for the support in finally getting this book published.
