Abstract

This study discussed the failure of imprisonment alternatives in achieving their goals of reducing prison populations and reducing the costs of imprisonment. The analytical descriptive approach was utilized to determine the causes of the problem and to explore a number of possible solutions. The study concluded that there are two main reasons for the problem. The first relates to weaknesses in implementing the alternatives resulting from several errors in implementation. Accordingly, the study suggested addressing this issue by raising awareness of the importance of imprisonment alternatives, not limiting backup sanctions to imprisonment, not applying contemporary alternatives as a replacement for traditional ones but as a replacement for imprisonment, and expanding the application of the alternatives. The second reason relates to the nature of the alternatives and their inability to replace imprisonment in the case of serious penalties. The study addressed this issue by suggesting a number of solutions, including benefiting from non-custodial penalties in the Islamic criminal system, reducing unjustified criminalization, expanding restorative justice, improving criminal justice efficiency, and reducing crime rates.
